OnePlus be banned selling OnePlus One in India

The Indian market is never an easy market for smartphone vendor to enter. Recently, we heard that Xiaomi was banned to sell devices in India by the Delhi High Court. The reason is that Ericsson complained that Xiaomi infringed their patents. And now, OnePlus is next turn.

Last tuesday, the Delhi High Court forbad the Chinese company from importing and selling OnePlus One in India. Apparently, it’s a little bit different from the previous case. Micromax have an exclusivity deal with Cynogen. And according to them, Micromax was given an exclusive licence to create and distribute Cyanogen’s technology as a part of its devices in India. Micromax has an exclusive licence for South Asia while OnePlus has a non-exclusive licence for the other countries, not China. “Micromax incurred major expenses for creation of a brand exclusivity for providing to Indian customers mobile phones with Cyanogen operating systems. It would suffer irreparable harm and loss if the defendants (OnePlus) are permitted to continue with their illegal acts in violation of the agreement between Micromax and Cyanogen”, said Micromax.

However, justice Manmohan Singh allowed the company, which released its OnePlus One handset in India through e-commerce website Amazon.com on 2 December, in a bid to sell its existing stock.

“In accordance with a judgement passed by the Delhi High Court, we will no longer be producing the OnePlus One with CyanogenMod to be sold in India. We are still fully committed to serving our users in the region and, in light of this decision, are working to find a solution that will allow us to continue operations as soon as possible,” said an official announcement from OnePlus. The Shenzen-based startup said its regret “the inconvenience this causes to OnePlus fans in India who have patiently waited for the opportunity to purchase the One”, said the Shenzen-based.

We have known before from OnePlus that the company is working on its own Android ROM, which was predicted to be available later this month. Thereby, the company will have to hurry its tasks if they still want continuously to sell their products in India.
